January 17, 2012 - Notice of Proposed Amendments to the Massachusetts Local Bankruptcy Rules

The United States Bankruptcy Court, with the valuable assistance of the Attorney Advisory Committee chaired by Chief Judge Frank J. Bailey and Judge Melvin S. Hoffman, has drafted new and proposed amendments to the Massachusetts Local Bankruptcy Rules.

Comments are invited, and should be submitted to Chief Judge Frank J. Bailey, United States Bankruptcy Court, J.W. McCormack Post Office and Court House, 5 Post Office Square, Suite 1150 and to Judge Melvin S. Hoffman, U.S. Bankruptcy Court, Harold D. Donohue Federal Building and Courthouse, 595 Main Street, Worcester, MA 01608 no later than March 8, 2012. Those who wish to email their comments should do so at fjb@mab.uscourts.gov and msh@mab.uscourts.gov.

December 10, 2010 - New Chief Judge for The United States Bankruptcy Court

The Honorable Frank J. Bailey has been appointed the Chief Judge of the United States Bankruptcy Court for the District of Massachusetts for a term of four years, effective December 10, 2010, He succeeds the Honorable Henry J. Boroff.

November 1, 2010 - IRS "Means Test" Standards changed effective November 1, 2010.

The various standards for the expenses in the "means test" form will change for all bankruptcy cases filed on or after November 1, 2010. Below is the link to the United States Trustees national webpage that contains the links to the various data.

July 6, 2010 - Notice of Change Affecting Invalid Creditor Addresses

EFFECTIVE JULY 12, 2010, THE BANKRUPTCY NOTICING CENTER WILL NOT MAIL NOTICES TO A CREDITOR IF ADDRESS IS INVALID. Please see the notice below for more information.

July 1, 2010 - Standing Order 10-03

The Court has issued Standing Order 10-03 which authorizes the Clerk's Office, sua sponte, to image as a "private event" exhibits or attachments to proofs of claim and other documents filed with the Court that contain medical information with respect to any person.

March 4, 2010 - Changes in Dollar Amounts in Bankruptcy Code

Many dollar amounts in the Bankruptcy Code, such as exemptions under section 522(d), the Chapter 13 limits under section 109(e), and priority claims under section 507(a), change on April 1 every three years; the document linked below reflects the changes that will occur for cases filed on or after April 1 of this year.

March 4, 2010 - IRS "Means Test" Standards Changing March 15, 2010

November 3, 2009 - Standing Order 09-04

The Court has issued Standing Order 09-04 that establishes a Mediation List or register of those persons who have advised the Clerk of the Bankruptcy Court that they are available to serve as mediators in disputes that arise in contested matters in bankruptcy cases or adversary proceedings. To be included on the Mediation List, the person shall represent to the Clerk, in writing, that he/she is qualified as a mediator, as defined by Massachusetts General Laws ch. 233, §23C. June 18, 2009 - Mediation Service

The U.S. Bankruptcy Court has a free mediation service available through the Real Estate Bar Association (REBA). The mediation service is directed to disputes that arise in Chapter 7 consumer or Chapter 13 bankruptcy cases involving real estate issues and is subject to availability. Interested parties may contact REBA directly (see the form of order below for contact information), but parties should inform the Court in the event they agree to participate in the program so that appropriate orders may issue. Below is a sample form of order and form of mediation agreement.
